The Department of State Services (DSS) has again failed to produce aides of the acclaimed Yoruba nation agitator, Sunday Adeyemo also known as Sunday Igboho, in court on Thursday as against the order for their production which was given last week.
The Nigeria secret police also disclosed that only 3 of the Yoruba activist’s are with them and not 12 as claimed by the media and some persons.
DSS’ lawyer, I. Aw, told a Federal High Court in Abuja on Thursday that, contrary to lawyers’ claims to the associates, the agency only has three of them in custody: Amoda Babatunde (aka Lady K), Diokola Adeyemo Ademola, and Bamidele Sunday.
According to Awo, the DSS also held Abdullateef Ofeyagbe (the first application) until July 27, when he was freed.
At the resumed hearing in a basic rights enforcement suit filed by 12 of Igboho’s acquaintances, the DSS’ counsel alleged that they had been arrested since the DSS raided Igboho’s Ibadan apartment on July 1.
Pelumi Olajengbesi, a lawyer for the petitioners, slammed Awo’s claim and asserted that the DSS was holding all of his clients.
Despite Awo’s efforts to explain why his client was unable to comply with the court’s direction, Justice Obiora Egwuatu reiterated the order that the applicants be produced on the next postponed date.
Justice Egwuatu ordered the DSS to give the applicants’ lawyers access to them immediately after the judgement and Monday.
He set a date for the DSS to appear in court and for the case to be heard again on August 2.
